Trade accounts from Terms and Conditions of Kays Electronics of Chesterfield.

We comply with UK trading laws

All accounts are payable - net - thirty (30) days from date of invoice.

Any account outstanding beyond our normal trading terms will be passed out of hand to our collection agency and will be subject to a minimum charge of twenty-five pounds. An interest charge of 6% will be charged on all outstanding amounts per month.

All goods and service I repair parts will remain the property of the company until payment is received in full and the customer shall remain a bailee only until payment is made.

Any damage or loss must be notified in writing to the company within three (3) days of the invoice date. The total consignment must remain as received - pending inspection by our carrier(s) before any liability is accepted.

All orders of over £150 net value , please phone for carriage charges, with the exception of 26 Kg or above plus rear shelf and sound box orders which will be despatched to the customer at £9.90 + VAT per parcel, orders of a less value than £150 will be despatched at cost of delivery.

Despatch to offshore clients will be at cost of delivery. Please contact for details.  A minimum charge of £22.50 will be made.

All orders received by noon will be despatched the same day subject to availability of the parts ordered, please use our part numbers when ordering. All prices are quoted subject to vat at the rate current at date of the relevant invoice.

The products offered in our catalogue may be the subjects of patents and other legal protection, we accept no liability for infringement of any such rights, we maintain full copyright in respect of our catalogue and any whole or partial reproduction is prohibited without our written consent.

Except in respect of death or personal injury caused by our negligence we shall not be liable to the buyer by reason of any representation (unless fraudulent) or any implied warranty condition or other term or any duty at common law or under any express term in the contract for any indirect, special or consequential loss or damage (whether for loss of profit or otherwise) costs, expenses or other claims for compensation whatsoever (whether for caused by our negligence or the negligence of our employees or agent or otherwise) which arise out of or in connection with the supply of the goods or their use or resale by the buyer. Our entire liability under or in connection with the contract shall not exceed the price of the goods except as expressly provided in these conditions. Where any valid claim in respect of any of the goods which is based on any defect in the quality or condition of the goods or their failure to meet specification is notified to us in accordance with these conditions we shall at our discretion either replace the goods (or the part in question) free of charge or refund to the buyer the price of the goods (or a proportionate part of the price) but shall have no further liability to the buyer.

Restocking charge 40% unless agreed other wise in writing.

Kays Electronics of Chesterfield reserves the right to alter products, specifications and prices, without prior notice to the purchaser.

Retail Terms.

Goods are not supplied on a trial basis.

All prices quoted are exclusive of VAT unless otherwise stated.

Unless we are specifically asked about requirements or compatibility, we shall assume the customer is aware of what these are.

If we have to part ship an order, due to temporary stock shortage, subsequent part shipments will not carry a delivery charge. We will always try to let you know if an item is out of stock at the time when you place your order. If, however, you order new release items, we shall hold the order until all items are in stock unless you agree to pay an additional shipping charge.

Prices and promotional offers are subject to change without notice. All are subject to availability.

MasterCard, Visa, Switch, Solo, Delta, cards are accepted without surcharge, however we reserve the right to delivery only to the card holders billing address or any other address acceptable to the card issuer.
Electron cards can only be used in person at our showrooms.

Your credit/debit card will be charged at the time of dispatch of goods.

Personal or business cheques are welcome but will need to be cleared before the goods are shipped. This takes up to 7 working days from when we receive the cheque. Banker’s drafts and building society drafts are acceptable as well as postal orders. These will be cleared immediately. You may also transfer funds (or pay by cash) directly into our bank account, in which case goods will be shipped as soon as funds have cleared. Please speak to a sales representative to obtain details and procedures.

No goods shall pass from Kays Electronics of Chesterfield to the customer until payment has been received in full. The customer is responsible for the goods from the time of delivery and liability to insure the goods then rests with the customer.

All products are subject to availability.

All products are covered by manufacturer's warranty.

All shipments in transit from Kays Electronics of Chesterfield are covered by carrier's insurance.

In most cases the Customer's signature will be required at time of receipt and goods cannot be left without a signature.

Claims for non delivery, missing items or damage to goods in transit must be made within 7 working days of expected delivery. Claims will not be accepted after this time.
'Dead on arrival’: Goods found to be faulty from new can be returned for replacement or refund. The customer must notify Kays Electronics of Chesterfield within 7 days of receipt of the goods.
The faulty goods will then be collected by Kays Electronics of Chesterfield courier.

Acceptable orders which have been placed and cleared by 3pm Monday to Thursday will be shipped on two to three day delivery in Mainland UK, (barring systems failure etc). If an order has not cleared in time, Kays Electronics of Chesterfield will contact the customer to inform them of any delay. Orders placed between 3pm on Friday and 3pm the following Monday, will be dispatched on Tuesday.

All illustrations and product descriptions featured in out advertisements, web site or brochures are correct at the time of going to press or web pages going 'live'. Any changes to the products will be mentioned on the website or at the time of ordering by mail order.

In the event of a delayed delivery or faulty goods, we can accept no responsibility for loss of earnings or event cancellations, which depend on the products in question arriving by a certain date.

The following terms apply to mail order consumers as defined in the Consumer Protection (Distance Selling) Regulations 2000 ("Regulations").

The consumer shall, subject to the terms set out in this Clause, have the right to cancel a Contract within 7 working days from the day after the date of delivery of the Goods by the Company to the consumer provided that he/she gives written notice of such cancellation.

A) If a consumer exercises his/her right to cancel a Contract, Kays Electronics of Chesterfield shall, in accordance with the Regulations, reimburse any payment made by the consumer within 30 days from the day on which he/she gave such notice of cancellation, provided that the consumer shall not be entitled to a prepayment in the event that:

A1) he/she does not take reasonable care of the Goods either prior to cancellation of the Contract or, following cancellation, while the Goods remain in the possession of the consumer. For the purposes of this sub-clause A1, a consumer shall be deemed not to have taken reasonable care of the Goods if such Goods are not kept packed in their original box, with all accessories, manuals and cables and the internal or external packaging is defaced or damaged in any way; or

A2) the Goods are marked, damaged or not in the same condition in which they are sold.

A3) If the goods have been used for more than the opportunity for initial testing out

The consumer is responsible for the cost of returning any unwanted items, or will be responsible for the direct cost of collection of such items.

These terms and conditions do not affect your statutory rights.
